1) Acceptance of these Terms
By accessing or using this website (everstrides.com and any sub-pages), you agree to these Terms of Use. If you do not agree, please do not use the website. These Terms govern site use only. For purchase terms, see Returns & Refunds and Warranty & ACL Rights (linked below).
(ACL rights apply to goods you buy regardless of any website terms.) 
2) Who we are

3) Website content & intellectual property
All text, product names, graphics, logos, photos, and other content on this site are owned by Everstrides or its licensors and are protected by law. You may view the site for your personal, non-commercial use only. You must not copy, reproduce, adapt, upload, publish, frame, scrape, or distribute any site content without our prior written consent.
Trademarks: “Everstrides” and associated marks are trademarks or trade dress of VHR Commerce Limited.
4) Information accuracy
We aim to keep product information, pricing, and availability accurate; however, errors can occur. We may correct any error or update content at any time without notice. Nothing on the site is a guarantee or representation that a product will be available at a particular time or price.
5) Your responsibilities (acceptable use)
You agree not to:
• use the site for unlawful purposes;
• introduce malware, attempt unauthorised access, or disrupt the site;
• use bots/scrapers to collect content;
• engage in conduct that is misleading or deceptive (including fake reviews or endorsements). (Misleading online reviews are prohibited under the ACL.) 
6) Accounts & security (if you create an account)
You are responsible for keeping your login details confidential and for all activity under your account. Notify us promptly of any unauthorised use.
7) User-generated content (reviews, photos, comments)
If you post a review, comment, photo, or other content:
• You warrant it is your original content, accurate, not misleading, and does not infringe others’ rights.
• You grant Everstrides a worldwide, royalty-free licence to use, reproduce, publish, translate, and display that content on our site, emails, ads, and social channels for marketing and customer information purposes.
• We may moderate, edit for length/clarity, refuse, or remove content (e.g., spam, profanity, offensive, irrelevant, or suspected fake reviews). (ACCC expects honest, genuine reviews; fake or manipulated reviews are unlawful.) 
8) Links to third-party sites
This site may contain links to third-party websites (e.g., payment providers, carriers). We are not responsible for their content or practices. Use them at your own risk.
9) Privacy & cookies
Your use of the site is subject to our Privacy Policy and Cookie Policy, which explain how we collect, use, store, and disclose personal information and how cookies work on our site. We comply with the Privacy Act / Australian Privacy Principles. 
Marketing emails/SMS are sent only with consent and always include an unsubscribe option that works. (Required under Australia’s Spam Act; heavy penalties for breaches.)

10) Accessibility

Product copy focuses on comfort and support. We do not provide medical advice and do not represent that products diagnose, treat, cure, or prevent any condition. Always seek advice from a qualified professional for medical concerns.
12) Disclaimers & limitation of liability (site use)
To the maximum extent permitted by law, the website is provided “as is” and “as available”. We do not warrant uninterrupted, timely, secure, or error-free access. We exclude all non-statutory warranties about the site to the extent permitted by law.
Nothing in these Terms affects your non-excludable rights under the Australian Consumer Law for goods you purchase (e.g., repair, replacement, or refund for major failures). 
13) Indemnity
You agree to indemnify Everstrides and its officers, employees, and agents against losses, costs, and liabilities arising from your breach of these Terms or misuse of the site.
14) Suspension or termination
We may suspend or terminate your access to the site (with or without notice) if we reasonably believe you have breached these Terms or applicable laws.
15) Changes to these Terms
We may update these Terms from time to time. The updated version will be posted here with a new Effective Date. Continued use of the site means you accept the updated Terms.
16) Governing law
These Terms of Use are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
